Please periodically review this Privacy Policy so that you know what personal information we collect, how we use it, and with whom we may share it.

This Privacy Policy may be supplemented or amended from time to time by other “privacy notices” posted on the Website or specific web pages within the Website. These privacy notices describe in more detail the personal information we collect on particular pages or areas of the Website.

This Privacy Policy is incorporated into and forms part of the terms and conditions of use for the Website or any of our online services.

1. What information does ECCO collect?

We collect information from you only when you choose to provide information to us, such as by purchasing our products, when you voluntarily provide it through the Website, or when you provide it to us through other means. The information we collect depends on how you use the Website or otherwise communicate or interact with us.

Personal Information.

Personal information means information about an identifiable individual (e.g., name, address, telephone number, e-mail address, payment information) but, to the extent permitted by the law, does not include the contact information of an employee of an organization. Personal information does not include anonymous or non-personal information (i.e. information that cannot be associated with or traced to a specific individual).

We collect personal information that you knowingly provide when you use the Website. For example, when you place an order for our products through the Website, we need to know personal information such as your name, e-mail address, billing address, phone number, and payment information to enable us to process and fulfill your order and contact you if we have any questions. If you create a personalized account with ECCO by registering for one on the Website, you will be required to provide us with similar personal information. You may provide us with preferences such as products you may be interested in. In any case, we’ll use the personal information you provided to us to make your shopping more efficient and to better serve your interests.

Now and then, we may conduct surveys, contests, mailings or other promotions. If you choose to participate in one of our surveys, contests mailings or other promotions, we may request personal information, such as your name, e-mail address, telephone number, shopping habits, interests and other personal information, to enable us to execute the promotion and notify winners. Some of this information will be mandatory to participate in the promotion; other information will be optional. We will tell you whether any personal information is mandatory or optional.

When you send us a request, we may ask you to identify yourself by name and/or e-mail address in order to send you a response, if appropriate.

Information Sent to Us by Your Browser.

Most of the information we collect from you at the Website does not personally identify you to us, although it may be unique or consist of information that you consider personal. For example, we collect information that is sent to us automatically by your Web browser or by using cookies, pixel tags, web beacons and other Web technologies. This information typically includes your IP address, the identity of your Internet Service Provider, the name and version of your operating system, the name and version of your browser, the date and time of your visit, the pages you visit and any search terms you enter while on the Website. This information cannot be used to identify you personally unless you identify yourself to us by, for example, making a purchase, creating an account or by giving us your e-mail address. If you provide us with personal information by creating an ECCO account or otherwise, we may link the information sent to us by your browser to the personal information you have provided to us.

Cookies, Pixel Tags, Web Beacons and Similar Technologies.

We use "cookies," “pixel tags,” “web beacons” and other Web technologies for a number of purposes, including:

  • to collect information about the ways you use the Website — for example, which pages you visit, which links you use, and how long you stay on each page;
  • to support the features and functionality of the Website. For example, to save you the trouble of re-entering information already in our database, or to prompt the settings you established on previous visits to the Website; and
  • to personalize your experience when you use the Website.

Generally, the information we collect using these Web technologies does not identify you personally.  If, however, you have provided us with personal information by creating an account on the Website or otherwise, we may link the information collected using these Web technologies to the personal information you have provided to us.

Cookies are small pieces of information stored by your browser on your computer’s hard drive.  Most web browsers accept cookies by default, but you can change your browser settings to refuse cookies.  If you do so, you may experience difficulties using the Website.

Pixel tags or web beacons are tiny graphic images used to help us analyze your online shopping patterns, create content designed for your connection speeds, and deliver e-mail in a format you can read.

When you access this Website by clicking on a link in an electronic communication you receive from us, your browser tells us that someone has clicked on a particular link in that particular electronic communication. We use this information to improve our marketing efforts. In addition, we review our server logs, which contain visitors’ IP addresses, for security and fraud prevention purposes. If criminal activity is suspected, we may share our server logs and the personal information we have collected through the Website with the appropriate investigative authorities who could use that information to trace and identify individuals.

Social media/integration with third party platforms.

The Website may permit you to interact with a third party website or service, such as enabling you to "like" us on another website or "share" content from the Website with third party websites (a "Social Networking Service"). If you choose to "like" or "share" content or to otherwise post personal information from or via the Website to a Social Networking Service, that information may be publicly displayed, and the third party may have access to certain information about you and your use of the Website. Similarly, if you interact with us through a Social Networking Service, We may have access to information about you (for example, if you "like" or "follow" Our page on a third party website).  Please note that if you mention or comment upon ECCO or the Website in your post to a third party platform, the third party platform may allow us to publish your post on the Website.

You may also choose to use a social media tool offered by a third party, but available on the Website (such as posting a review). Use of such features may allow us to collect (or the third party to share) information about you, including personal information. When you choose to use a social media tool available through the Website, you may be opting to link your activity on the Website with that third party website or service, which may then collect information about your visits to the Website and may publish that activity as you request to your profile or similar feature with that third party.

In addition, we may receive information about you if other users of a third party website give us access to their profiles and you are one of their "connections" or information about you is otherwise accessible through your "connections" web page, profile page, or similar page on a social networking or other third party website or interactive service.

The information collected and stored by the third party remains subject to the third party's privacy practices, including, but not limited to, whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third party website and service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but we may retain the information previously collected.

Analytics.

Portions of the Website may also use analytical tools (collectively, “Analytical Tools”) that are operated by us and third party providers, such as Google, Inc. and Demandware, Inc., which may use cookies, web beacons, scripts and similar means for the purpose of collecting information and analyzing how you use the Website. Information collected using Analytical Tools will be transmitted and stored on servers located outside of Ontario, specifically in the United States. The third party providers of Analytical Tools may also transfer this information to other third parties (such as governmental authorities) where they are required to do so by law, or where such third parties process the information on their behalf. As some Analytical Tools rely on cookies to perform their functions, you can avoid having your usage data collected by those Analytical Tools by disabling cookies in your browser.

Advertising.

We use the services of third party advertising networks and similar vendors (“Third Party Ad Providers”) to serve our advertisements online, including advertisements based upon your prior visits to the Website.

Third Party Ad Providers may collect certain information, including personal information, over time about you and your visits to the Website or other websites. These third parties may set and access their own tracking technologies on your computer or mobile device, including, but not limited to, cookies and web beacons, and may otherwise collect or have access to your IP address and information about your visits to and activity on our Website as well as third party websites and online services. These cookies and web beacons may be used to, among other things, target advertisements from (including our advertisements), prevent you from seeing the same advertisements too many times and to conduct research regarding the usefulness of certain advertisements to you.

Some of our Third Party Ad Providers may be members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. You may want to visit //www.networkadvertising.org/managing/opt_out.asp, which provides information regarding targeted advertising and the "opt-out" procedures of NAI members. You may also want to visit or //www.aboutads.info/choices/, which provides information regarding targeted advertising and offers an "opt-out" by participating companies in the DAA Self-Regulatory Program. Please note opting out through these mechanisms does not opt you out of being served advertising. You will continue to receive generic ads while online.

When you use the Website to apply for a job, you will be asked to provide certain personal information, such as your name, address, telephone number, email address, educational background and employment history. You may also send us your resumé and other information relating to your job search or application. We may also use the personal information you provide to us to personalize your shopping experience by using your product interests, shopping patterns and purchase information to recommend other products, services or promotions that we believe you may be interested in.  We may also notify you of changes to the Website.

We may combine the information you provide to us with data that is publicly available and data that we collect in ECCO stores, at our marketing events, or receive from other sources whose policies meet industry standard privacy practices and applicable legal requirements.

We may also use your personal information to investigate security breaches or cooperate with government authorities pursuant to a legal matter.

3. Does ECCO Share Your Information with Third Parties?

We may share your personal information with our trusted third party service providers to help us manage and operate the Website, process your orders, perform statistical analysis, send you e-mail, postal mail or text messages, provide customer support and perform other important services.  Although these partners may not be affiliated with us, they are required to maintain the confidentiality of your personal information and are not authorized to discuss, disclose or make any use of your personal information except as necessary to provide such services. We may use service providers located outside of Canada, and, if applicable, your personal information may be processed and stored in other countries and therefore may be subject to disclosure under the laws of those countries.

Unless you have given us your permission to do so, we will not share your personal information with unaffiliated third parties for the purpose of enabling those third parties to offer you products or services or otherwise market or promote to you.  Further, unless you have given us your permission to do so, we will not share any personal information with any affiliates of ECCO.  However, we may partner with third parties to help us collect and aggregate certain information collected at the Website. We may share this aggregated, non-personal information with existing and prospective business partners and advertisers. None of the aggregate information will contain any information that identifies you individually.

If you select an alternative means of payment for any order (e.g., PayPal or another form of alternate payment), you provide the personal and financial information needed to process your application or purchase directly to each provider associated with processing the payment.  The companies that administer these programs are independent of ECCO and have their own privacy policies.

We and our third party service providers may disclose specific personal information if we or they reasonably believe that it is necessary to: (i) investigate any suspected misuse of the Website; (ii) comply with applicable federal, provincial or municipal laws, rules, regulations or orders; (iii) to protect or defend the rights, property and interests of ECCO, our customers, or the interests of our third party service providers; or (iv) under exigent circumstances, to protect the personal safety of users of the Website or the public.

Your personal information may be transferred to another entity that succeeds to all or part of ECCO’s business in connection with a sale, reorganization, consolidation or merger.

You are deemed to consent to disclosure of your personal information for those purposes.

4. Retention of Personal Information

Personal information collected in any form will only be retained by us so long as it is necessary: a) for the purposes for which it was collected; b) to be retained by law; c) to address any issues that may arise at a later date. The length of time we retain personal information varies, depending on the nature of the information. The retention period may extend beyond your relationship with us. When your personal information is no longer required for our purposes, the information is either physically destroyed or deleted.

5. How Can You Unsubscribe or Change Your Information?

We want to communicate with you only if you want to hear from us.  If you have provided us with your personal information, but later decide you no longer want us to send you any commercial information, you may unsubscribe by using the unsubscribe message in any of our commercial electronic communications.   To unsubscribe from an e-mail list, please follow the instructions in any e-mail you receive.

If you would like to update or change your personal information or preferences, or if you would like to have it removed or corrected, please send your request to us via the points of contact listed at the end of this Privacy Policy. Please provide your full name, company name, address, and email address so that we can locate you.  We will respond to your request within a reasonable period of time and we will use reasonable efforts to comply with your request; however, in some cases we may not be able to allow you to access certain personal information in certain circumstances, for example if it contains personal information of other persons, or for legal reasons. In such cases, we will provide you with a reasonable explanation of why it is not possible to grant access to your personal information.  If you have an account with us for the Website, you may update or change your personal information or preferences through such online account.

6. What Security Measures Does ECCO use to Protect Your Information?

We take care to provide a level of security appropriate to the sensitivity of the personal information we collect and maintain. We protect your personal information by maintaining physical, organizational and technological safeguards (appropriate to the sensitivity of such personal information) and designed to help protect against unauthorized use, disclosure or access.

Although we use reasonable and prudent measures to protect our Website, computer systems and any personal information that we have collected from unauthorized access, use, disclosure, misuse, alteration or destruction, no security measures can provide absolute protection. As a result, we cannot guarantee the security of information provided over the Internet or stored in our databases. Your transmissions are, therefore, at your own risk.

Not all of the pages on the Website are secure. Most of the pages on our Website provide information to you about ECCO and our products and do not allow you to provide us with personal information. As a result, these pages are not secured using encryption or other technology.  We do, however, use encryption technology to secure all pages that allow you to provide us with personal information and/or purchase our products.  You may use your browser tools to identify whether any particular webpage is “secure” or not.

All online transactions through the Website are secured using Secure Sockets Layer (SSL) technology to secure the personal information you provide to us.  The information you provide when you place an order is encrypted (or coded) using a secure server intended to maximize security. This encryption makes it extremely difficult, but not impossible, for a third party to access your information within ECCO’s servers.

Personal information we collect is stored and processed on servers located in Canada and the United States. Accordingly, your personal information may be subject to access requests from federal or State governments, courts, or law enforcement in the United States.

The Website may, from time to time, contain links to websites owned and operated by third parties (“Third Party Sites”).  Third Party Sites may have their own privacy policies and terms and conditions that are not governed by this Privacy Policy. We are not responsible for the privacy practices or the content of Third Party Sites. Third Party Sites may collect and treat information collected differently, so we encourage you to review the privacy policies of such Third Party Sites so that you understand how those website collect, use and share your information.

The Website is intended for a general audience and is not intended to be used by children under the age of majority in their jurisdiction of residence. Cookies, Pixel Tags, Web Beacons and Similar Technologies.

Visitors who register or participate in other Website features such as marketing programs and 'members-only' content will be given a choice whether they would like to be on our e-mail list and receive e-mail communications from us. If you would no longer like to receive promotional e-mail from us, you may opt-out using the unsubscribe feature in any of our commercial email;
  • to carry out other purposes that are disclosed to you and to which you consent; and
  • to carry out any other purpose permitted or required by law.

7. Links to Other Websites

Any links from this Website to Third Party Sites, or references to products, services or publications other than those of ECCO, do not imply the endorsement or approval of such websites, products, services or publications by ECCO.

Access to and use of the Website is made available only to people who can form legally binding agreements under applicable law. The Website is intended for a general audience and is not intended to be used by children under the age of majority in their jurisdiction of residence. ECCO does not knowingly collect personal information from children under the age of majority in their jurisdiction of residence.  Children accessing the Website should obtain the permission and assistance of a parent or legal guardian.
